Those opposed to the placement of boat slips along the Oliver Lake Resort channel have been asked to submit a letter of protest to the Indiana Department of Natural Resources. A strong response to this situation is needed. A couple of letters have already been written by Patrick Wiltshire and Donna Moran. They have allowed their letters to be used as a "template" for other people wanting to voice opposition. The letters can be found of the Documents page.

The Indiana Department of Environmental Management approved the construction of the 514 linear feet glacial seawall along Oliver Lake for bank stabilization. The IDEM believes that the project will comply with the Clean Water Act. Read the full approval letter.

LAWSUIT FILED AGAINST
OLIVER LAKE RESORT

Approximately 44 residents and area property owners filed a lawsuit against Oliver Lake Resort Cooperative, Inc and JK Property Investments, LLC. The lack of available time and need for quick action prevented a general notice to every lake resident. It was also not advised that the Oliver Lake Association be a part of this action since it technically does not own any property. At this time, the Oliver Lake Association is not involved in this lawsuit.
The purpose of the lawsuit is to require and ensure compliance by this developer with LaGrange County’s Zoning Ordinance & Subdivision Control Ordinance as well as the terms of the Special Exception for this RV campground originally granted to Richard Misner.
It is believed that the proposed 88-year lease renewable into perpetuity is a subdivision of land requiring Subdivision approval of the Plan Commission, and this has not occurred. The lawsuit also alleges that the use provisions of the zoning ordinance and the Special Exception allow only RVs, not permanent homes with permanent foundations, or a trailer park. Chris Godlewski, the Zoning Administrator, has communicated to the developer in two separate letters that the development is a subdivision, requiring Plan Commission approval but nothing further has happened by way of enforcement. We are simply asking the developer to comply with the law and for the Zoning Administrator to enforce the law.
Many in the group suggested that other lake owners should join in the lawsuit. Any one is welcome that wants to. It has been suggested that a contribution of $250.00 per household to defray the cost of the litigation but realize some cannot contribute that amount - hopefully others that can do more will do so. Jeff Wible has graciously agreed to take the case on a reduced hourly rate. It is urged that all property owners and residents to contact their elected officials urging LaGrange County enforcement of the Zoning Ordinance, the Subdivision Control Ordinance and the Special Exception against the Oliver Lake Resort developer.
